What are the 9 HOAI service phases?
Phase 1 Basic evaluation, 2 Preliminary design, 3 Design development, 4 Permit submission, 5 Construction documents, 6 Bid preparation, 7 Bid evaluation, 8 Construction supervision, 9 Project documentation. Defined in HOAI § 34 (architects), § 55 (structural and TGA engineers).
Which fee zone applies to TGA planning?
TGA planning is typically billed under fee zone II or III per HOAI § 56. Zone IV (above-average requirements) applies only to special-use buildings with high cross-system complexity: hospitals, cleanroom labs, large assembly halls.
What is the difference between HOAI 2013 and HOAI 2021?
Key difference: HOAI 2013 contained binding minimum and maximum fees (struck down as EU-incompatible by ECJ ruling 4 July 2019, C-377/17). HOAI 2021 turns the fee tables into non-binding guideline values — fees may now be agreed freely, including below the table values.
When is an architect plus TGA planner required?
For permit-required construction (i.e. nearly all buildings except small garden sheds, garages under 100 m² etc.), the building application in Bavaria must be signed by a permit-eligible architect or engineer (Art. 61 BayBO). A TGA expert planner joins by complexity, often by phase 3.
Who is liable for planning errors?
Planners are liable for design defects under BGB § 634 of the contract law. The standard limitation period for building defects is 5 years from acceptance (BGB § 634a). Professional liability insurance is mandatory — TGA-typical coverage: at least €1.5–3 million per claim.
How is the HOAI minimum rate handled after the 2019 ECJ ruling?
Since the ECJ ruling C-377/17 of 4 July 2019, the HOAI minimum and maximum rates are no longer binding. In practice, table values still serve as an orientation; in public-sector tendering they're often used as a comparison basis. Fee agreements clearly below table values are now legal.
